Pine Hosting agrees to furnish services to the client, subject to the following (Terms of Service). Pine Hosting, the company hereafter referred to as Pine Hosting and The Client. Use of Pine Hosting constitutes acceptance and agreement to ToS (Terms of Service). All provisions of this contract are subject to change from time to time at the discretion of Pine Hosting. Clients understand that change to the ToS by Pine Hosting shall not be grounds for early contract termination or non-payment.
REFUNDS AND DISPUTES
All eligible hosting service orders placed by newly registered clients are eligible for refunds within the first 48 hours of the creation of the server in our database, this point is not marked by the time at which your initial payment is processed and may differ by several hours. All refunds are made through the gateway in which initial payments were made. All of our other services, including product addons and domains are not eligible for a refund. Refunds cannot be requested without probable cause; in addition to this non-monthly terms are non-refundable. Our 48-hour money-back guarantee applies to a new client’s first order only. To request a refund, you must submit a refund request via a support ticket system outlining the reason. If you meet the terms of eligibility, a refund will be issued by a team member. Refunds will not be issued automatically.
Payop payments are not eligible for a direct refund and instead can only be refunded in account credit. This means that if you have made a payment using Payop, you will not be able to receive a refund in the form of cash or back to your original payment method. Instead, the refund amount will be credited to your account as credit that you can use towards future purchases on our platform.
MISCONDUCT
In the event that a client engages in any behavior that may be deemed rude, abusive or threatening we reserve the right to terminate their service immediately and retain the discretion to withhold eligibility for a refund. This decision will be made at our sole discretion and is intended to maintain a respectful and safe environment for all parties involved.
CANCELLATIONS
To terminate your services you must cancel via our WHMCS billing area at https://pinehosting.com/clientarea/ using the cancellation request form. A cancellation request must be submitted when a client wishes to no longer proceed with their service. Accounts with a credit card on file will automatically attempt to renew until cancelled. Unless specified per special arrangement, Pine Hosting do not hold our clients accountable to any contracts. Pine Hosting clients can cancel at any time.
EXPLOITATION
Clients are disallowed from exploiting services to modify settings of features beyond which they are permitted in their rental agreement. For instance, a client may not modify their slot count to an amount which differs from what they are renting from us.
LIABILITY LIMITATION AND EXCLUSION
Pine Hosting, under no circumstances, shall be held liable for any data loss. Pine Hosting shall not be held liable for any disruption, delay, or disconnection of services for any period. We reserve the right to terminate a client’s services in the event of a charge dispute, despite the outcome of the dispute.
SUPPORT
Any support requests required for products from Pine Hosting shall be submitted through the billing system via tickets. Any other form of contact other than the predetermined ticket system is not guaranteed a proper answer from an official representative.
TERMINATION
We reserve all rights to terminate your server or service upon any violation of these terms or any other basis if deemed needed. Services which are suspended for non-payment will be terminated 7 days after the renewal invoice is due. We do not terminate services without cause.
LEGAL CONTACT
Pine Hosting retains the right to seek and consult with any appropriate authorities that may need to be involved in the event of an issue arising whether it is through violation of this policy or any other illegal occurrence requiring the involvement of law-enforcement agencies. Pine Hosting regards any communication between parties as confidential, upon distribution of any communication, unless prior approval is in place, we will take action to the full extent of the law. By purchasing a server from Pine Hosting you permit us to modify your server, this includes, but is not limited to, changing settings, uploading/mods, and other tasks related to running any server. Any verbal or written action to compromise our server systems or any other equipment owned by Pine Hosting will be taken seriously and will result in further investigation and possible lawsuits. Upon cancellation of payments to Pine Hosting your server will be suspended unless prior arrangements are made. Files will be kept as long as possible after termination or suspension however the guaranteed amount of time is unspecified. Pine Hosting retains the sole right to stop, start, and modify your server at any given time.
